Question: Are various berries (blackberries, raspberries and blueberries) subject to orlah?
Answer: Interestingly, there are only very few sources that discuss berries and their status regarding orlah. The Poskim write that blackberries are subject to orlah, and blueberries would appear to also be. Raspberries (or petel) are subject to much debate regarding their orlah status because the bush upon which they grow lasts for several years. It appears that in chutz lo’oretz there is certainly room to rely on the lenient views who maintain that raspberries are not subject to orlah (because we rule that in chutz lo’oretz sofek orlah is permitted, unlike in Eretz Yisroel where sofek orlah is forbidden). Rav Mordechai Eliyahu in Ma’mar Mordechai (Volume 3 Orach Chayim Siman 11) also clearly rules (based on inspecting the bush and speaking to the farmers who grow the berries) that raspberries are ho’adomo and are also not subject to orlah [even in Eretz Yisroel].
