Question:Is one allowed to tovel in a mikva that is currently being refilled? Answer:First and foremost, a mikva has to contain a minimum of 40 se’ah to be kosher; if the mikva is only partially full and there is not this quantity of water in the mikva, the mikva is completely invalid. Secondly, the aperture that connects the bor hashoko to the mikva needs to be completely full of water; if it is only partially full then there is a serious sheilo of zechila between two bodies of water. The third concern is the opinion of the Divrei Chaim who maintains that zechila into a mikva invalidates the mikva just as zechila out of a mikva. However, ex post facto, or if there is no alternative, one can certainly rely on the many authorities who maintain that zechila is only an invalidation for water flowing out of a mikva. |
